1. INTRODUCTION
Welcome to the IBRAH CAR AWARD AFRICA FESTIVAL AND AFRICA LUXURY AUTOMOTIVE AWARD INITIATIVE, presented by 100 Africa Entertainment Incorporated, headquartered at No. 1 Airport Square. Airport Residential Area, Accra, Ghana. These Terms of Service govern your access and use of our platform, including but not limited africaluxuryautoawards.com, and any other related websites, mobile applications, media forms, or communication channels associated with this initiative (collectively referred to as the “Platform”).
For clarity, references to “Services” throughout this document are included within the term “Platform” unless explicitly stated otherwise.
These Terms of Service, together with our Privacy Policy, Refund Policy, Cookie Policy, Winner Package Terms and Conditions, Voting and Jury Terms, Winner Package Order Form, and other documents published from time to time on the Platform (collectively referred to as the “Terms“) establish a legally binding agreement between you and us regarding the use of the Platform and participation in our awards programs.
PLEASE NOTE: THESE TERMS CONTAIN A MANDATORY ARBITRATION CLAUSE TO ADDRESS ANY DISPUTES BETWEEN YOU AND US. BY ACCEPTING THESE TERMS, YOU WAIVE YOUR RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION SUIT.
By clicking “Accept,” nominating an individual or business, signing up as a jury member, creating an account, or otherwise accessing or using the Platform, you agree to abide by these Terms and all related policies and conditions set forth herein and incorporated by reference. If you do not agree with these Terms, including the arbitration and class action waiver provisions, please do not use the Platform.
By accepting these Terms, a binding agreement is established between 100 Africa Entertainment Incorporated (referred to as “100 Africa”, “we”, “us”, or “our”) and you (referred to as “you”, “your”, or “user”), whether as a nominee, representative, or juror. Together, the parties are referred to as the “Parties.”
2. DEFINITIONS
- “Awards” means any of the award programs organized by 100 Africa Entertainment Incorporated, including the Ibrah Car Award Africa Festival and Africa Luxury Automotive Award Initiative.
- “Nominee” refers to businesses or individuals nominated to participate in our Awards.
- “Nominations” includes both complimentary and premium nomination submissions, as outlined on the Platform.
- “Winner” means the individual or organization selected as a recipient of an award, eligible to purchase a Winner Package.
- “Winner Package” refers to a paid offering that includes rights associated with the award title, including use of a winner certificate, badge, and trophy.
Additional definitions may appear throughout these Terms and should be interpreted accordingly.
3. THE SERVICE
Our Platform enables users to nominate themselves or others for participation in the Awards. Users may also apply to serve as jury members under our applicable terms. Winners are determined via a voting and evaluation process as per the Voting and Jury Terms and Conditions. Upon selection, winners must order the Winner Package through the official Winner Package Order Form and under the conditions specified therein.
4. ELIGIBILITY
To use our Platform, you must:
- Be of legal age and have the capacity to enter into binding agreements;
- Complete the registration process truthfully;
- Agree to all applicable Terms;
- Provide accurate, up-to-date legal and contact information;
- Have the authority to act on behalf of the organization you may represent;
- Agree to use the Platform for non-commercial purposes only;
- Confirm that your use of the Platform complies with applicable laws and regulations.
100 Africa reserves the right to deny access or modify eligibility at any time.
5. PERSONAL DATA
To deliver our Services, we collect personal data including (but not limited to) names, email addresses, phone numbers, social media handles, experience, skills, and organization details. Your submission of such data is considered consent. Please refer to our Privacy Policy for further details on data handling and protection practices.
6. TERM
These Terms remain in effect from the moment you first access the Platform and for as long as you continue to use our Services. Signing in to your account constitutes formal acceptance of the Terms.
7. ACCOUNT REGISTRATION
To access the Platform fully, you must register for an account. You agree to:
- Provide complete and accurate information;
- Avoid using misleading, offensive, or unauthorized identifiers;
- Maintain the confidentiality of your login credentials;
- Report any breach of security or unauthorized access promptly;
- Accept communications from 100 Africa via email or SMS, which constitute valid legal notice.
You are solely responsible for activity under your account.
8. NOMINATIONS AND FEES
8.1 Nominations
8.1.1 Nominations may not be submitted free of charge.
8.1.2 Please refer to the official website of the Ibrah Car Award Africa Festival and Africa Luxury Automotive Award Initiative for updated eligibility criteria. 100 Africa Entertainment Incorporated reserves the right to amend eligibility for nominations at its discretion without prior notice.
8.1.3 Nominations may be canceled within seven (7) working days of submission. After this period, a cancellation service fee of USD 499 will apply.
8.2 Use of Winner Title
No nominee—whether via free or paid plan—may publicly announce their winner status or use award-related intellectual property (logo, title, or brand name) without purchasing a Winner Package.
8.3 Free Plan Obligations
Nominees under a complimentary plan who are selected as winners are required to purchase a Winner Package within ten (10) days of internal notification. Failure to do so may result in revocation of the winner title, reassignment of the award, and a mandatory service fee of USD 499, covering account creation, voting design, jury evaluation, and administrative processing. This fee does not grant any usage rights of the award IP, digital badges, or public announcements.
8.4 Payment Terms
All service fees, including those for cancellations, nominations, or Winner Packages, must be paid within seven (7) days of invoice issuance. Non-payment may result in legal recovery proceedings.
8.5 Paid Nominations
8.5.1 Paid or “Premium Nominations” allow for multiple category entries, enhanced visibility, and additional benefits.
8.5.2 Premium Nominations do not guarantee winning status.
8.5.3 Discounts on Winner Packages or event tickets are non-transferable and non-refundable.
8.5.4 100 Africa may, at its discretion, provide limited marketing visibility to Premium Nominees through platform highlights.
8.5.5 All payments are final and non-refundable. Refer to our Refund Policy for details.
8.5.6 Nomination fees only cover entry into the awards program and are separate from Winner Package costs.
8.5.7 Winner Package pricing is not bundled with Paid Nominations.
9. PARTICIPATION TERMS
9.1 Voting results remain confidential.
9.2 Nominees have no claim on 100 Africa’s promotional activities or audiences.
9.3 Voting process data and audience insights are proprietary and not disclosed.
9.4 It is the participant’s responsibility to update any changes in nomination details.
9.5 Award branding (logo, name, certificate) may only be used after official public winner announcement and purchase of a Winner Package.
9.6 All nominations are self-submitted or selected by our internal team. Accuracy of information is the nominee’s responsibility.
9.7 Participants may nominate multiple categories but can win a maximum of two. No refunds are issued for non-winning categories.
9.8 Only upon purchasing a Winner Package are rights to use winner assets (certificate, badge, trophy) granted. Shipping fees apply for physical items.
9.9 Trophies provided at gala events are for display; official awards will be shipped as per the Winner Package.
9.10 100 Africa reserves the right to change or withdraw award categories based on internal evaluation.
9.11 Winners may only publicly declare their award status after our official announcement date.
9.12 Promotional activities undertaken by participants are at their own cost and discretion.
9.13 No participant shall be entitled to claim damages or benefits related to promotional outcomes.
9.14 Winning does not guarantee commercial return (sales/bookings).
9.15 Non-winners may not request information regarding other winners or results. All decisions by 100 Africa and jury are final.
10. PARTNERSHIP OPPORTUNITIES
10.1 Partnership roles (advertising/sponsorship) require a formal agreement with 100 Africa Entertainment Incorporated. No WhatsApp or verbal confirmation shall be treated as binding authorization to act on behalf of the initiative.
11. WINNER TERMS
11.1 Winners are determined solely by the jury and management team. All decisions are final.
11.2 Only upon purchasing a Winner Package can winners publicly promote their award and use IP elements.
11.3 Unauthorized use of award IP or other participants’ IP is strictly prohibited.
11.4 Winner announcement emails are informational only and do not confer rights.
11.5 Digital Winner Materials are valid for three (2) years. Renewal is required for continued use.
11.6 Physical Winner Materials (trophies, plaques) may be retained indefinitely.
11.7 100 Africa may use winner brand assets on its platform without time limits.
11.8 100 Africa may offer voucher-based trade options in lieu of monetary payment for the Winner Package under exceptional circumstances.
11.9 Breach of Terms can result in title withdrawal and forfeiture of all award-related materials.
11.10 Only the rights explicitly outlined herein are granted; no additional rights are implied.
11.11 Winners will be listed on the platform for 7 days. Continued listing requires Winner Package purchase.
11.12 Participants may request removal from the Winners list by submitting a formal request.
11.13 Fees may be collected in multiple currencies. Currency conversion and related fees are the participant’s responsibility.
11.14 No refunds or cancellations are applicable after nomination or package payment.
12. GALA CEREMONY
Attendance at the gala ceremony is not included in nomination or Winner Package fees. Separate ticket purchase is required. Admission may be restricted for violations or failure to meet internal standards.
13. COMMUNICATIONS
By using the Platform, you consent to receiving communications from us via phone, SMS, WhatsApp, or email. Standard carrier charges may apply.
14. AUTOMOTIVE OR AUTOMOBILE INSPECTION (Where Applicable)
14.1 For automotive, an inspection voucher covering vehicles must be provided for evaluation purposes. Inspection may enhance award chances but does not guarantee winning.
14.2 Post-award inspections may be conducted within 3 months. Awards may be revoked if quality compliance is not met.
14.3 Inspection does not guarantee complimentary Winner Package.
14.4 Vouchers may be used by jury, management, or their authorized representatives.
15. PROHIBITED ACTIVITIES
Users agree not to:
- Extract or compile Platform data without permission.
- Use the Platform for unsolicited communication.
- Impersonate other users or create false accounts.
- Bypass Platform security or misuse intellectual property.
- Use the Platform to mislead, harass, or spam.
- Promote competing ventures using Platform content.
- Upload harmful or disruptive content.
Engagement in any such activity may result in suspension, disqualification, or legal action.
16. LICENSE
16.1 Subject to these Terms and Conditions, 100 Africa Entertainment Incorporated grants you a limited, revocable, non-sublicensable, non-exclusive, and non-transferable license to use the platform associated with the Ibrah Car Award Africa Festival and Africa Luxury Automotive Award Initiative solely in accordance with these Terms. You are strictly prohibited from using, reproducing, modifying, distributing, or storing any content outside the scope of the permitted use without prior written consent from 100 Africa Entertainment Incorporated.
17. OUR RIGHTS AND RESPONSIBILITIES
17.1 100 Africa Entertainment Incorporated reserves the right to disqualify any entries, participants, or winners at its sole discretion, at any time, without prior notice.
17.2 All decisions made by the management and the designated jury of the Ibrah Car Award Africa Festival and Africa Luxury Automotive Award Initiative are final and not subject to appeal.
17.3 We retain the right to alter, cancel, or modify any aspect of the program, including but not limited to award categories, event names, titles, pricing, logos, schedules, number of winners, or the gala ceremony location and structure, without prior notice.
17.4 We may determine eligibility at our discretion and reserve the right to qualify or disqualify participants for failure to comply with these Terms.
17.5 We also reserve the right to revise, cancel, or withhold any benefits, features, or deliverables associated with nomination or award status without prior notification.
18. USER RESPONSIBILITIES
18.1 You agree to use the platform solely through the official access methods provided by 100 Africa Entertainment Incorporated, unless otherwise authorized by a formal agreement.
18.2 You bear full responsibility for any breach of these Terms and any resultant consequences, including damages or losses incurred by us or third parties.
18.3 Misrepresentation of identity, qualifications, or unauthorized access to another account is strictly prohibited.
18.4 You must comply with all applicable laws, rules, and regulations.
18.5 Submission or promotion of any unlawful, offensive, defamatory, or discriminatory content is forbidden.
18.6 You agree to follow all applicable policies related to platform use and interactions.
18.7 Actions that undermine review processes or ratings are not allowed.
18.8 Multiple account registrations, impersonations, or unauthorized account transfers are prohibited.
18.9 Activities inconsistent with the intent of the platform or the awards are not permitted.
18.10 You may not promote the awards or collect payments on behalf of 100 Africa Entertainment Incorporated unless explicitly authorized in writing.
18.11 You may not represent yourself or your business as an official sales or marketing affiliate of 100 Africa Entertainment Incorporated or any of its award programs without prior written approval.
19. INTELLECTUAL PROPERTY RIGHTS
19.1 All digital content, media, and materials available on the Ibrah Car Award Africa Festival and Africa Luxury Automotive Award Initiative platform are proprietary to 100 Africa Entertainment Incorporated. Users are granted no ownership rights.
19.2 All logos, marks, and branding associated with the platform and the awards remain the exclusive property of 100 Africa Entertainment Incorporated or its licensors.
19.3 By submitting materials, including logos, images, testimonials, or other content, you grant 100 Africa Entertainment Incorporated a non-exclusive, worldwide, royalty-free license to use such content for promotional purposes across all media formats. Participation in the awards constitutes your agreement to these promotional uses in perpetuity.
19.4 All feedback or suggestions provided by users become the sole property of 100 Africa Entertainment Incorporated, with full rights for adaptation and commercialization.
19.5 Any user found to be infringing intellectual property rights may have their access terminated without prior notice, and may be barred from future participation in any 100 Africa Entertainment Incorporated programs.
20. THIRD-PARTY SERVICES
The platform may link to third-party websites or services, which are outside of our control. 100 Africa Entertainment Incorporated is not responsible for the content or performance of these third-party resources. Your interaction with such entities is at your own risk.
21. TERMINATION
We may terminate or suspend your account or access to the platform at any time, for any reason, without notice. Termination does not entitle you to a refund of any fees paid. All provisions intended to survive termination will remain in effect.
22. RELEASE
To the fullest extent permitted by law, you release 100 Africa Entertainment Incorporated, its partners, and affiliates from all liability, including for any claims, damages, or disputes arising from your use of or reliance on the platform or related services.
23. Warranty Disclaimer
The services, platforms, and digital content provided by 100 Africa Entertainment Incorporated, including those relating to the Ibrah Car Awards Africa Festival and the Africa Luxury Automotive Award Initiative (collectively, the “Platform”), are provided strictly on an “as is” and “as available” basis. Use of the Platform is at your own sole risk.
100 Africa Entertainment Incorporated makes no express or implied warranties, guarantees, or representations of any kind, including but not limited to warranties of title, merchantability, fitness for a particular purpose, accuracy, non-infringement, or those arising from course of performance, usage of trade, or otherwise—except as explicitly required by applicable law.
We, our affiliates, officers, directors, employees, partners, agents, licensors, and content providers do not warrant that:
- The Platform will be uninterrupted, secure, or available at any specific time or location;
- Any defects or errors will be corrected;
- The Platform is free of viruses or other harmful components;
- Any content, data, or information available through the Platform is accurate, complete, or reliable;
- Any services, products, or awards delivered through the Ibrah Car Awards Africa Festival or Africa Luxury Automotive Award Initiative meet specific user requirements or expectations;
- Use of the Platform complies with laws, regulations, or professional requirements applicable to the user.
No assurance is made that any content, material, or service will remain available through the Platform at any time.
24. Indemnification
You agree to indemnify, defend, and hold harmless 100 Africa Entertainment Incorporated, its affiliates, and its officers, directors, employees, contractors, agents, and partners from and against all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- Your access to or use of the Platform;
- Violation of any applicable law or regulation (including privacy or consumer protection laws);
- Misuse or unauthorized use of personal or proprietary information;
- Infringement of intellectual property rights;
- Any breach of these Terms.
We reserve the right to assume exclusive control over any matter subject to indemnification. You agree to cooperate fully at your own expense in the defense of such matters.
25. Limitation of Liability
To the fullest extent permitted by law, 100 Africa Entertainment Incorporated shall not be liable under any theory of law (including contract, tort, strict liability, or negligence) for any:
- Indirect, incidental, punitive, special, or consequential damages;
- Loss of profits, revenues, goodwill, data, or business opportunities;
- Personal injury or death related to use or misuse of the Platform;
- Malware or harmful code obtained through the Platform;
- Disputes between users or with third parties;
- Direct damages exceeding the amount paid by you (if any) in the three months preceding the incident.
Remedies under these Terms are exclusive and limited to those provided herein.
26. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of Ghana.
In the event of any dispute arising from or relating to these Terms or the Platform (a “Dispute”), the parties shall attempt to resolve the matter amicably. If unresolved within 30 days, the Dispute shall be submitted to arbitration before a mutually agreed arbitrator. If the parties cannot agree, a judge shall appoint one. Arbitration decisions shall be final and binding. Arbitration costs will be equally shared unless otherwise directed by the arbitrator.
27. Limitation on Time to File Claims
All claims relating to use of the Platform or services, including those under the Ibrah Car Awards Africa Festival and Africa Luxury Automotive Award Initiative, must be filed within one (2) year of the cause of action, or they will be permanently barred.
28. Class Action Waiver
You agree not to participate in or initiate any class action. All claims must be brought individually and may not be consolidated without our consent.
29. Modification
We reserve the right to modify these Terms or any aspect of the Platform at any time. Notice may be provided via the Platform, email, or other appropriate means. Continued use after notice constitutes acceptance of the modified Terms.
30. Miscellaneous
30.1 Ownership & Management
All events and initiatives, including the Ibrah Car Awards Africa Festival and the Africa Luxury Automotive Award Initiative, are solely owned and managed by 100 Africa Entertainment Incorporated. These programs are not affiliated with any government or public authority.
30.2 Contact Point
Your designated representative shall serve as the main point of contact unless otherwise stated.
30.3 Evaluation Process
Evaluations may be conducted using automated or digital systems. We disclaim liability for any resulting errors, to the extent permitted by law.
30.4 Duplicate Entries
Duplicate or frivolous entries may be disqualified. It is your responsibility to report or remove such entries.
30.5 Intellectual Property
Use of any logos, materials, or content related to the Awards must comply with guidelines. Modifications must be made promptly upon our request.
30.6 Administrative Communications
All official communication must be directed to our Dubai, UAE office.
30.7 Non-Circumvention & Non-Disparagement
You agree not to bypass our organization in dealings or disparage the company or its affiliates publicly or privately. Breaches may result in claims of not less than GBP 10,000 or higher if legally permissible.
30.8 Conflict of Interest
We reserve the right to disclose any relevant conflicts of interest, as required by law.
30.9 No Cancellations
Once submitted, entries are final and non-refundable. Submitted data may be used for future reference or promotional purposes.
30.10 Entire Agreement & Severability
These Terms represent the full agreement. If any provision is invalid, the remainder shall remain enforceable.
30.11 Relationship of the Parties
No partnership, joint venture, or agency is formed by these Terms.
30.12 Force Majeure
We are not liable for any failure due to events beyond our control.
30.13 Assignment
These Terms are personal to you and may not be transferred. We may assign our rights without restriction.
30.14 Notices
Notices to us must be in writing and sent to our official communication channel. Notices to you will be sent to your last known email address.
30.15 No Waiver
Failure to enforce any right shall not constitute a waiver of future rights.
30.16 Interpretation
Section titles are for convenience only and have no legal effect.

Voting Terms and Conditions
1. INTRODUCTION
1.1 Thank you for participating in the Ibrah Car Awards Africa Festival and the Africa Luxury Automotive Award Initiative, organized by 100 Africa Entertainment Incorporated (“we,” “us,” “our,” or the “Organizer”). These Voting Terms and Conditions (“Agreement”) are a binding component of our overall terms and govern your use of our voting services. This Agreement applies to all users (“you,” “your,” “nominee”) who access our services through our websites, mobile applications, media channels, and other affiliated platforms (collectively referred to as the “Platform”).
Please review these Terms before engaging with any aspect of the Award Program, including casting or soliciting votes.
2. VOTING & WINNING CRITERIA
2.1 Each valid vote cast in favor of you or your establishment contributes to your chances of being selected as a Winner.
2.2 The final outcome is determined by a combination of public votes and internal evaluations carried out by our appointed jury and the internal team at 100 Africa Entertainment Incorporated. This evaluation may also include qualitative criteria at our discretion.
2.3 All decisions regarding Winner selection are final, non-negotiable, and non-appealable. Please refer to our full Terms and Jury Conditions for additional insights into our evaluation procedures.
3. WINNER DECLARATION & CLAIMS
3.1 Participation in the voting process does not guarantee any monetary benefit, promotional rights, digital services, or Winner Package access unless you are officially declared a Winner by 100 Africa Entertainment Incorporated or its jury.
3.2 Only officially recognized Winners are eligible to claim associated benefits as outlined in the Winner Package Terms.
4. UNAUTHORIZED PROMOTION
4.1 If you or your organization independently conduct promotional activities involving the Ibrah Car Awards Africa Festival, the Africa Luxury Automotive Award Initiative, or any of our affiliated branding, without our prior written consent, 100 Africa Entertainment Incorporated shall bear no responsibility for such actions or associated costs.
4.2 We recommend ceasing any such activities immediately and contacting us to withdraw your nomination if needed. No refunds or compensation will be provided under such circumstances.
5. CONFIDENTIALITY OF VOTING PROCESS
5.1 The voting and Winner selection process is strictly internal and confidential. You are not entitled to access any proprietary information, including but not limited to:
- Voter identities or data
- Voting tallies and statistics
- Competitor information
- Internal evaluation methods
All information related to the awards process is held in strict confidence by the Organizer and its jury.
6. INTELLECTUAL PROPERTY USAGE
6.1 Nominees may use the official nominee badge, certificate, and voting banners provided by 100 Africa Entertainment Incorporated during the voting period.
6.2 Usage of any additional intellectual property—such as award logos, event branding, Platform content, or Winner announcements—is strictly prohibited unless expressly authorized in writing.
6.3 Usage rights related to the Winner Package are granted only to officially declared Winners and are subject to compliance with the relevant Winner Package Terms.
7. VOTING PROCESS & CONDITIONS
7.1 Each legitimate vote carries a value of one (1) point.
7.2 Voting timelines may be modified at our discretion, and updates will be communicated via the Platform.
7.3 All votes are subject to eligibility screening. The Organizer reserves the right to reject any votes it deems suspicious or fraudulent.
7.4 We reserve the right to disqualify participants if fraudulent or irregular voting patterns are detected.
7.5 Decisions related to voting, disqualification, or eligibility are final and solely at the discretion of 100 Africa Entertainment Incorporated.
7.6 Any breach of these Terms may lead to disqualification from the program and termination of your nomination. In such cases, refunds will not be issued unless explicitly stated by us.
7.7 Displayed vote counts on the Platform may be adjusted following internal verification and validation processes.
7.8 Email verifications may be sent to voters to authenticate votes. Failure to confirm may result in disqualification of those votes.

Refund Policy & Privacy Policy
1. INTRODUCTION
Thank you for participating in the Ibrah Car Awards Africa Festival and the Africa Luxury Automotive Award Initiative, organized and managed by 100 Africa Entertainment Incorporated.
Please read this Refund Policy (“Agreement”) carefully before making any payments for services offered through our website, mobile platforms, media channels, or any related or connected platforms (collectively referred to as the “Platform”).
This Agreement forms an integral part of our Terms and Conditions, and the references and terms used herein shall carry the same meaning as those defined in our Terms and Conditions and Winner Package Terms and Conditions, unless explicitly stated otherwise.
2. REFUND POLICY FOR WINNER PACKAGE
Upon being selected as a winner, you will be eligible to purchase a Winner Package in accordance with the associated Terms and Conditions. Only after completing this purchase may you disclose your award status publicly or to any third party.
It is expressly agreed and understood that all payments made toward the Winner Package are non-refundable. Under no circumstances shall any payments, whether in full or part, be refunded once a transaction is completed for the Winner Package.
3. CANCELLATION OF ORDER
Cancellation rights, if any, will be governed by the applicable terms and conditions.
Once a payment is made for the Winner Package, no cancellation or refund—either partial or full—will be permitted by the participant.
In the unlikely event that 100 Africa Entertainment Incorporated cancels or modifies the Winner Package after payment has been received, we will offer either an equivalent alternative service or issue a refund limited to the amount paid for the portion of the Winner Package not delivered. Any such refund shall not exceed the original amount paid by the winner.
If a full refund is approved and the winner has already received any products or services, the winner must return all items in their original condition in order to initiate the refund process.
4. DAMAGED PRODUCTS
If any part of the Winner Package is found to be damaged during shipment or transportation provided by 100 Africa Entertainment Incorporated, we will replace the damaged items at no additional product cost.
